Dismissal Done Right: What Every Employer Should Know About South Africa's Code of Good Practice

Dismissing an employee is one of the most difficult decisions an employer can make. While there may be valid reasons for ending an employment relationship, a dismissal that is not handled fairly can expose a business to costly disputes before the CCMA, Bargaining Councils or the Labour Court.

Every year, employers lose unfair dismissal cases—not because the employee was innocent, but because the disciplinary process was flawed. A poor investigation, an unfair hearing or inadequate documentation can undermine an otherwise justified dismissal.

This is why South Africa's Code of Good Practice on Dismissal, contained in the Labour Relations Act, remains one of the most important guides for employers.

Its purpose is not to prevent dismissals, but to ensure they are fair.
